ATLANTA (AP) – A Fulton County jury has awarded a couple from Georgia $2.25 million in a lawsuit against Dr. Jackson Gates, a pathologist accused of posting graphic videos of an autopsy of their decapitated baby. The couple, Jessica Ross and Treveon Isaiah Taylor Sr., had hired Gates to perform the autopsy on their son, Treveon Taylor Jr., who was tragically decapitated during delivery in July 2023.
The pair has also initiated a separate lawsuit against the doctor who delivered their baby, as well as the hospital where the delivery took place. This additional case is currently pending in the court system.
In a lawsuit filed in September 2023, Ross and Taylor alleged that Dr. Gates uploaded several distressing videos of the autopsy to Instagram without obtaining their consent. According to their attorneys, Gates initially removed the videos after receiving a letter from the couple's legal representatives, but subsequently reposted the disturbing content.
In his defense, Ira Livnat, an attorney representing Dr. Gates, claimed that the jury found Gates did not intend to cause any harm, which he argued contradicts the essence of the plaintiffs' case. Livnat explained that his client often shared posts about autopsies to educate fellow pathologists and promote independent evaluations for patients who suspected malpractice by hospitals.
The couple was awarded a default judgment attributed to intentional infliction of emotional distress, invasion of privacy, and fraud after Dr. Gates failed to respond to their initial lawsuit in a timely manner. Livnat emphasized that Dr. Gates expressed deep remorse for any unintended harm he may have caused the couple, stating, “Had he known for one second that they would see that and that they would know it was their child, he would never have done it.”
In response to the jury's decision, the couple's attorneys issued a statement, asserting that Dr. Gates “poured salt into the couple’s already deep wounds.” They described the trust that the young couple placed in him regarding their child and highlighted the violation of that trust when Gates shared such horrific images publicly.
This case has raised important questions about ethical practices in the medical field, particularly surrounding the handling of sensitive situations involving families who have experienced devastating loss.
