OTTAWA – A critical report from a military justice watchdog has scrutinized the investigation into a sexual assault allegation against former army officer Dany Fortin, highlighting significant flaws in the investigative process. The Military Police Complaints Commission released its final report on December 9, 2025, examining the actions of the Canadian Forces National Investigation Service pertaining to a claim that dates back to 1988, during Fortin’s time at military college.
The commission's findings indicate that the investigation was affected by "tunnel vision" and bias, suggesting a failure to uphold essential investigative standards. Commission chairperson Tammy Tremblay noted that the evidence does not substantiate Fortin’s assertion that the prosecution was influenced by "undue external pressure" to accept the alleged victim’s claims without critical scrutiny.
Despite the conclusions drawn by the commission regarding investigative shortcomings, they also determined that the claims put forward by Fortin concerning undue external influence were not supported by the evidence reviewed. The report emphasized that, while the process faced significant imperfections, the systemic issues within the investigation did not validate Fortin’s claims of being wrongfully prosecuted.
Dany Fortin, who held the rank of major-general, was put in the spotlight when he was stripped of his role as head of Canada’s COVID-19 vaccine rollout campaign in May 2021. This action came as he was under investigation for the sexual assault allegation, which later resulted in a civilian court trial.
In December 2022, Fortin was acquitted of one count of sexual assault, concluding a pivotal chapter in his legal battles. Following this acquittal, he retired in 2023, a move that coincided with the settling of a lawsuit against the military and senior government officials for an undisclosed amount, marking an end to his long-standing legal and professional turbulence.
